Pottery Classes, Workshops, Retreats & Commissions

Part A — Liability Waiver, Release & Assumption of Risk

This Waiver, Release of Liability and Assumption of Risk (“Waiver”) applies to all pottery classes, workshops, retreats, private sessions, wheel demonstrations and studio visits (each, a “Session”) offered by Motions of Clay, operated by Ronaldo Wiltshire (“Motions of Clay,” “we,” or “us”), whether:

held at the Motions of Clay studio, Cambridge, St. Andrew, Barbados (the “Studio”); or
held off-site as a workshop, retreat, or private session at a partner or host location, including but not limited to Andromeda Botanic Gardens, Haymans Market, Peg Farm / Farm House Restaurant, Royalton Vessence, Hamilton’s Pottery, or any other venue at which a Session is hosted (each, a “Host Venue,” and its owners and operators, the “Property Owners”).

References below to the “Studio” and “Host Venues” together are referred to as the “Venue” for the relevant Session.

1. Booking Constitutes Agreement — No Signature Required

This Waiver takes effect automatically and does not need to be signed. By booking, registering for, or paying for a Session in any way — including through the Motions of Clay website, by direct bank transfer, by redeeming a voucher or gift card, by phone, by message, or in person — the participant (“Student,” “you”) automatically and irrevocably accepts and agrees to be bound by the full terms of this Waiver. This applies whether the Session is paid, complimentary, or promotional, whether booked for the Studio or for a workshop or retreat at a Host Venue, and regardless of whether any signature is ever given. Confirmation of a booking is, by itself, confirmation that the Student has read, understood, and agreed to these terms.

2. Assumption of Risk

Working with clay, glazes, pottery wheels, kilns, tools, and studio equipment carries inherent risks. The Student voluntarily and knowingly assumes all such risks, including but not limited to:

Cuts, pinches, or abrasions from tools, wire, trimming equipment, or the pottery wheel
Burns or heat-related injury from kilns, glaze firing, or other heat sources
Skin, respiratory, or allergic reactions to clay, glaze, dust, or other studio materials
Slips, trips, or falls on wet, clay-dusted, or uneven Venue surfaces
Muscle strain or repetitive-motion discomfort from wheel-throwing or hand-building
Damage to clothing, jewelry, electronics, or other personal property brought to the Session
For workshops and retreats held at a Host Venue: risks specific to that location, including its grounds, structures, furnishings, transport to and from the site, and outdoor or garden settings

This list is illustrative and not exhaustive. The Student confirms they are physically able to participate and will inform Motions of Clay in advance of any condition, injury, allergy, or limitation relevant to their safe participation.

3. Release of Liability

Motions of Clay, Ronaldo Wiltshire, and the Property Owner are not liable for any injury, illness, or death sustained by a Student during a Session, however caused.

In consideration of being permitted to participate in a Session, the Student, on behalf of themselves and their heirs, executors, and next of kin, releases, waives, and discharges Motions of Clay, Ronaldo Wiltshire personally, and each Property Owner, together with their respective staff, instructors, agents, and representatives (together, the “Released Parties”), from any and all claims, demands, actions, or liability for injury, illness, death, or property damage or loss arising out of or in connection with participation in a Session, however caused.

The Student agrees that if they are injured or otherwise harmed during a Session, neither Motions of Clay, Ronaldo Wiltshire, nor any Property Owner is at fault, and the Student assumes full and sole responsibility and liability for any such injury or harm, except where caused by the gross negligence or wilful misconduct of a Released Party, which this Waiver does not release.

4. Property Damage

The Student agrees to take reasonable care of tools, equipment, and the Venue premises — whether the Studio or a Host Venue — and to reimburse Motions of Clay or the relevant Property Owner for any damage caused by their negligent or intentional acts during a Session.

5. Medical Treatment Authorization

In the event of injury or medical emergency during a Session, the Student authorizes Motions of Clay staff or instructors to arrange or obtain emergency medical treatment on their behalf, and agrees that any cost of such treatment is the Student’s own responsibility.

6. Photography & Media

Motions of Clay may photograph or film Sessions for studio records and promotional use, including on Instagram and other social media. A Student who does not wish to be included may notify Motions of Clay in advance or ask not to be photographed on the day.

7. Participants Under 18

A parent or legal guardian must make or approve the booking on behalf of any participant under the age of 18. Doing so — including by bank transfer or voucher, as set out in Section 1 — constitutes the parent or guardian’s agreement to this Waiver and full responsibility on the minor’s behalf, in addition to supervising the minor as appropriate for the Session.

8. Governing Law & Severability

This Waiver is governed by the laws of Barbados. If any provision of this Waiver is found unenforceable, the remaining provisions remain in full force and effect.

Acknowledgment

This Waiver applies automatically from the moment a Session is booked or paid for, as set out in Section 1. No signature, printed copy, or separate confirmation is required for it to take effect. A copy of this Waiver is available on the Motions of Clay website and on request at the Studio.

For a parent or guardian booking on behalf of a participant under 18: completing the booking (including by bank transfer or voucher) constitutes your agreement to this Waiver on the minor's behalf, in addition to supervising the minor as appropriate for the Session.

Part B — Terms & Conditions

These Terms & Conditions govern your booking, purchase, and participation in classes, workshops, retreats, and bespoke commissions offered by Motions of Clay. By booking, purchasing, or attending any class, workshop, or retreat, or by placing a commission order, you agree to these Terms.

Bookings & Payment

All bookings must be paid in full at the time of booking to confirm your place.
Accepted payment methods: bank transfer, FirstPay, PayPal.
We cannot confirm or hold your place until full payment is received.

Refunds, Transfers & Rescheduling

If you need to cancel: We operate a no-refund policy for cancellations made by clients. If you cannot attend a booked session, contact us as soon as possible and we will try to reschedule you to the next available class, subject to availability, but this cannot be guaranteed.
Cancellations made within 48 hours of the class will not be eligible for rescheduling.

Cancellation by Us

We reserve the right to cancel or change the date, time, or location of any class or course where necessary or if it is impractical to run.
We may make reasonable amendments to course content without prior notice.
If we cancel your session and cannot offer a suitable alternative within a reasonable period, you will receive a full refund for that session.

Commissions & Bespoke Orders

Motions of Clay currently works exclusively on commission, creating bespoke domestic ware (including cups, mugs, and similar pieces) to order.

Bespoke and personalised pieces are non-returnable unless they arrive damaged or defective.
Production and delivery times will be confirmed at the time of order.
Any design changes requested after production has begun may incur additional fees.

Returns & Damaged Goods

We do not accept returns for bespoke or personalised items unless they are defective or damaged in transit.
If your order arrives damaged, notify us within 48 hours of delivery with photos and your order details, so we can assess and, where applicable, offer repair, replacement, or refund.

Health, Safety & Allergies

It is your responsibility to inform us prior to a class of any medical conditions, allergies, mobility issues, pregnancy, or other special requirements.
By attending classes, you accept the inherent risks associated with pottery and ceramic processes. Please follow instructor guidance and safety instructions at all times.

Communications & Data Protection

By providing your contact details, you consent to receive transactional messages about your bookings and orders.
Motions of Clay is committed to protecting your privacy and handling your personal data transparently and securely.
We use your details only to process bookings and orders, and to communicate with you about your sessions.

Amendments

These Terms & Conditions may only be amended at the discretion of management.

Part C — Frequently Asked Questions

How do I book?

Choose a class and pay in full at booking; your place is confirmed once payment is received.

Can I get a refund if I can't attend?

No refunds; contact us as early as possible and we will try to move you to the next available class, though this can't be guaranteed. Cancellations within 48 hours of the class are not eligible for rescheduling.

What if you cancel a class?

We will offer an alternative date or issue a full refund if no suitable alternative is available.

Can I return a commissioned piece?

No, unless it arrives damaged or defective — report within 48 hours with photos.

What if I have allergies or special needs?

Tell us before attending so we can accommodate you safely.

How is my data used?

To process bookings and orders, and to communicate with you about your sessions.
